For Blake Lively, the dismissal of her harassment allegation against Justin Baldoni is a “huge blow” and a “huge win” for Baldoni, an attorney said.
But a second legal personnel told People that her non-dismissed claims are still “strong.”
On Thursday, a federal judge’s written ruling tossed out Blake’s majority of allegation included sexual harassment, defamation, and conspiracy. Only a few claims such as breach of contract and retaliation, are allowed to proceed.
Entertainment litigation attorney, Gregory L. Doll, labelled the ruling a win situation for Baldoni while calling the trial a “tough” road for Blake.
But attorney Megan Thomas said the remaing claim are still “strong” and that the actor and producer are “not off the hook.”
Gregory insisted, “The sexual harassment claims individually… have always been very weak.”
He continued, “It’s a huge blow to Blake’s side, and it’s a huge win for Justin. I think she’s got a tough road… proving retaliation and damages is going to be really difficult to do.”
The Lawyer added that now Baldoni is not personally connected to the lawsuit and the remaining claims are against the companies involved in the case.
On the other hand, Megan, a sexual harassment attorney, said, “Some claims were dismissed, including sexual harassment, because they were not legally viable.
“The claims that remain, breach of contract, retaliation, and aiding and abetting retaliation, are more substantial and will move forward.”
She agrees the ruling is “a blow to Lively” but point outs that Baldoni is “not off the hook.”
